The contracting of services or the sale of products through the website www.progresscycles.com owned by Fun Sport Express SL, (from now on FUNSPORT), means the acceptance of the following general conditions of the contracting (from now on, "The General Conditions"). These general conditions are available for the clients in Spanish language.

 

ACCEPTANCE AND AVAILABILITY OF THE GENERAL TERMS AND CONDITIONS

By accepting the General Conditions you declare:

  • That I am a person of legal age and with the necessary legal capacity to contract or, if applicable, that I have the authorization of the legal guardian to do so.
  • That I have read, understand and accept the General Conditions.

FIRST. OBJECTIVE

The purpose of this agreement is the purchase and acceptance by the CUSTOMER of the products/services offered on this website by the company, and the delivery chosen by the CUSTOMER, in accordance with the terms and conditions set forth in the clauses of this document.

SECOND. PURCHASE PROCEDURE

To place a purchase order, the Customer must follow each of the steps of the purchase procedure provided on the Website, price and method of payment.

THIRD. PRICE, METHODS OF PAYMENT AND DELIVERIES

A. PRICE

In consideration for the publications purchased, the CLIENT expressly agrees to pay to the company the amounts specified at that time in the price list established on the website www.progresscycles.com for the corresponding selected item. The sales prices indicated on the website are shown with taxes (VAT), but once in the shopping cart and identified with the shipping address, the prices are broken down with the corresponding taxes.

Shipping costs are NOT included in the prices indicated for each item. These are indicated at the time of placing the purchase order.
The CUSTOMER will be responsible for any taxes, import duties and/or customs duties required by local authorities for the delivery of your order.
Shipments to the Canary Islands, Ceuta and Melilla are subject to import taxes and/or local customs charges. Orders are shipped through a freight forwarder.

B. PAYMENT METHODS

Payment by bank card: The Customer must include the number of your debit / credit card (Visa, Visa Electron and Mastercard), as well as other additional information, which is required in the purchase procedure. The charge will be made once it has been accepted by the Customer's financial institution, otherwise the purchase will not be completed.
Payment through the Paypal platform. This platform offers several payment options, including the option to pay by debit/credit card or from its platform.

All payment processes are carried out through secure servers and the company guarantees the confidentiality of communications with the CUSTOMER, in accordance with our Privacy Policy.
Once the purchase is successfully completed, you will be sent by email a confirmation and all the details of your purchase. The buyer will be able to request a copy of the invoice free of charge once the order has been shipped.

C. DELIVERY OF PRODUCTS

Orders are delivered through an external logistics company. The delivery time may vary depending on the location of the delivery point of the order, and the availability of publications. Exceptionally, the deadlines for receipt of the product may vary due to circumstances beyond the company's control, such as indecencies in transport or difficulties in the delivery of the products.
The CLIENT has to facilitate the delivery of the purchased product and indicate if there is any particularity or difficulty to receive the purchase made. The company is exonerated for any extraordinary delay, the origin of which is due to problems in receiving the product by the CUSTOMER.
Shipping costs are indicated at the time of purchase of the chosen products.
In the event that the customer, once the purchase has been made, modifies the delivery address, he/she may do so as long as the order has not yet been shipped.
FUNSPORT is not responsible for the errors or damages caused in the delivery when the address entered by the CLIENT is not correct.
FUNSPORT will be able to deliver the products in several shipments.
In case the package cannot be delivered due to any reason, such as incorrect address, absent addressee, refusal of the package, etc... The package will be returned to our facilities. In such cases the CUSTOMER will have to bear the shipping and return costs, as well as possible associated handling fees. The CUSTOMER will be refunded only the price of the product paid by the same method of payment used at the time of purchase.

FOURTH. RETURNS

In the case of manufacturing defects or errors in the delivered product, returns or exchanges of parts will only be accepted if the original packaging is included and it is proven that it is a manufacturing or packaging defect or anomaly and NOT of improper or negligent use, handling or storage by the CUSTOMER. They will always be accompanied by the corresponding delivery note or invoice.
Both in the case of return due to manufacturing or packaging defect and in the case of error in the order, the CUSTOMER will be offered the replacement of the product for an equal one, at no additional cost and without right, on the part of the CUSTOMER to any type of compensation, or the refund of the product depending on its country or city of origin. The expenses generated by the shipment of the repaired or correct product will be borne by the company.
In any case the return will always be subject to a prior examination by the company of the state of the product to be returned and verification that the requirements of these conditions of sale have been completed. Upon receipt of the return and if applicable, we will refund the amount charged within a maximum period of 14 calendar days from receipt and using the same payment method used to make the payment.
The company reserves the right to refuse returns communicated or sent outside a period of (60) days or products that are not in the same condition as they were received.
For the return you can use the same box or envelope in which the product was sent, or failing that in some packaging that ensures the perfect condition of the product during shipment.
The cost of the return shall be borne by the CUSTOMER except in cases where the product is defective. At the time of return, we recommend using a shipping method that includes delivery confirmation.
For returns from outside the Iberian Peninsula, please contact our Customer Service team before making the return.
Returns will be managed by sending an email to: pedidos@progresscycles.com with a description of the reasons and the alleged causes for the return. Likewise, it will be necessary to indicate the name, surname and invoice number of the order. Once we receive the request, we will process it in a timely manner.
Returns will not be accepted when the products have been opened and used, and do not keep the original packaging.

FIFTH. RIGHT OF WITHDRAWAL

The customer has the right to withdraw from this contract within a period of (14) calendar days without justification.
The withdrawal period will expire after (14) calendar days from the day on which the CUSTOMER, or a third party indicated by the CUSTOMER, other than the carrier, acquired the material possession of the goods. To exercise the right of withdrawal, the CUSTOMER will have to notify the company by e-mail to: pedidos@progresscycles.com, its decision to withdraw from the contract through an unequivocal statement. You can use the model withdrawal form in the following link, although its use is not mandatory.

SIXTH. WAIVER OF LIABILITY

The opinions expressed in the publications accessible from this website belong to their respective authors, editors or distributors. The company is directly and indirectly exonerated from any responsibility.

SEVENTH. AVAILABILITY

The company cannot guarantee the availability of all products on its website at all times.
All product purchase orders are subject to product availability.
In the event that the product purchased by the user is out of stock, FUNSPORT will notify him/her as soon as possible and may offer him/her a product of similar characteristics of equal or superior quality, although the CLIENT may cancel his/her purchase and be reimbursed within a maximum period of (14) days.

EIGHTH. COMMUNICATIONS

All notifications between the parties will be made via email. The CLIENT is responsible for confirming the reception of the notifications and for informing the company of any modification on its data, being exonerated from any responsibility derived from this circumstance. In case of modification, the CLIENT, will have to inform the company in the e-mail pedidos@progresscycles.com.

All PROGRESS wheels have been developed together with professional cyclists, using them for thousands of kilometers, and should not fail. We guarantee that each wheel has been hand-centered by one of our experts. Nothing compares to a hand-centered wheel.

Wheels PROGRESS use standard spokes and nipples, and any bike store should be able to perform repairs or maintenance.

The warranty of the products sold through the Website shall be in accordance with the provisions of the legislation in force and, therefore, in general, FUNSPORT shall be liable for any lack of conformity expressed by the Customer within three (3) years from the delivery of the products for products purchased as of January 1, 2022 and two years for products purchased prior to that date.

In particular, if the product sold by FUNSPORT is not in conformity, the Client may choose between the repair or the replacement of the product (unless one of these options proves impossible or disproportionate) or, alternatively, between a price reduction or the termination of the contractual relationship in accordance with the legislation in force. In any case, the Client shall inform FUNSPORT of the lack of conformity within a maximum period of two (2) months from the time he/she became aware of it. FUNSPORT will assume the costs of returning the products in this type of assumptions.
Notwithstanding the above, it will be understood that the products are in conformity and, therefore, they will be out of any warranty when:

  • The warranty is not transferable to two owners.
  • Damage or deterioration of the products sold by FUNSPORT due to causes beyond the control of the manufacturer or FUNSPORT or, if applicable, of whoever acts under its responsibility (force majeure, accident, etc.) or as a consequence of an incorrect configuration and/or installation of the product by the Client.
  • Damage or deterioration in the products sold is caused or originated by a component not supplied by the manufacturer or FUNSPORT or is the result of alterations or repairs carried out by persons other than the manufacturer or FUNSPORT or, if applicable, by whoever acts under their responsibility.
  • This warranty does not cover damage caused during transportation, storage, accidents, improper use, shock, poor maintenance, failure to follow instructions, improper assembly, use of non-compatible accessories, normal wear and tear, or unauthorized modifications.
  • The components subject to wear are the brake shoes, the aluminum Freehub bodies and the bearings.
  • All our road wheels use Rims ultralight carbon or aluminum. Therefore, we do not recommend the use of "metal composite" brake pads.
  • The warranty does not cover brake shoes or the braking surface of Rims for tubular or Clincher.
  • This warranty does not cover damage caused during transportation of the products; this type of damage must be claimed directly from the corresponding carrier.
  • FUNSPORT does not cover transportation costs. After receipt of a warranty and its positive evaluation, FUNSPORT will bear the cost of return.

If the wheels were not purchased on our website, claims must be made through authorized sales outlets.

In case of breakage due to accident, PROGRESS helps you by offering you a Rim at half the usual price within 1 year from the date of purchase.

If the customer registers his wheels in the CRASH REPLACEMENT program within 2 months of purchase, this service is extended for a second year.
